Terms of Service

These Terms of Service (the "Terms") govern your use of the Lusendova website and client portal at lusendova.com (the "Service"). Lusendova is a corporate gifting service operated by Main Street Liquor, a licensed retailer of alcoholic beverages (referred to as "Lusendova", "we", "us" or "our"). By requesting an invitation, creating an account, or placing an order, you agree to these Terms on behalf of yourself and the company you represent.

1. Eligibility

You must be at least 21 years old and authorized to make purchases on behalf of your company to use the Service. Every recipient of a gift must also be at least 21 years old, and someone 21 or older must be present to sign for delivery.

The Service is offered to businesses and their authorized representatives. It is not intended for consumers purchasing for personal use.

2. Invitation-only accounts

Access to the portal is by invitation. We may accept or decline any request for an invitation at our discretion. Each account belongs to a client company and may have one or more authorized users. You are responsible for keeping your login credentials confidential and for all activity under your account, including orders placed by your authorized users.

Tell us promptly at the contact address below if you believe your account has been used without authorization.

3. Products, pricing and availability

Each client account carries its own pricing, which is shown inside the portal and includes any agreed service margin. Prices, shipping charges, taxes and gift option fees are shown before you pay. Prices may change without notice for future orders but not for an order that has already been confirmed.

Many bottles in the collection are allocated or limited releases. Availability is confirmed when the order is accepted. If a bottle becomes unavailable after you order, we will offer a substitute of equal or greater value or a refund for that item; we will not substitute without your consent.

4. Orders and payment

An order is accepted when we confirm it by email. We may refuse or cancel any order, including where we cannot lawfully ship to an address, where fraud is suspected, or where a recipient does not meet the age requirement, in which case any amount paid for the cancelled portion is refunded.

Card payments are processed by Stripe at checkout. We do not store card numbers. Where invoiced billing has been approved for an account in writing, invoices are due on the terms stated on the invoice, and we may suspend ordering on overdue accounts.

You are responsible for applicable sales taxes, which are calculated and shown at checkout based on the destination of each shipment.

5. Shipping, delivery and risk of loss

Gifts are sold and shipped by a licensed retailer only to destinations where such shipment is permitted by law. Every shipment requires the signature of an adult aged 21 or older; carriers will not leave alcohol unattended. Shipments that cannot be delivered after the carrier's attempts may be returned to us, and re-shipping charges may apply.

You are responsible for the accuracy of recipient names and addresses. Corrections after an order has been processed may incur carrier address-change fees.

Delivery dates are estimates. Title and risk of loss pass to you when the carrier accepts the shipment, except that we will replace or refund items lost or damaged in transit when reported to us within 7 days of the carrier's delivery date.

Local white-glove delivery, where offered, is subject to the delivery area, fees and gratuity shown at checkout.

6. Personalization: engraving, gift boxes and messages

Engraving, gift boxes and printed messages are produced to your instructions. Please review text carefully; engraved text is reproduced as entered, and we are not responsible for typographical errors in text you supply. We may decline to engrave or print content that is unlawful, defamatory, hateful or otherwise objectionable.

Personalized items are made to order and are not returnable except where defective or damaged.

7. Cancellations, changes and returns

You may cancel or change an order at no charge until it enters processing, which for engraved or boxed orders is typically within one business day of confirmation. After that point, personalized items cannot be cancelled. Non-personalized, unopened items may be returned within 14 days of delivery, subject to a restocking fee and applicable law; alcohol returns are accepted only where permitted.

Refunds are issued to the original payment method.

8. Recipient information

You represent that you have the right to provide us with each recipient's name, address and other details, and that doing so complies with applicable privacy laws and your own policies. We use recipient information only to fulfill and support your orders, as described in our Privacy Policy.

9. Responsible service

We are committed to the responsible sale of alcohol. We will not sell to anyone under 21, and we may refuse or cancel any order or delivery where the age requirement cannot be verified.

10. Intellectual property

The Lusendova name, mark, site content and portal are owned by us or our licensors and may not be used without permission. You retain rights in any logos or text you provide for personalization and grant us a license to reproduce them for that purpose.

11. Disclaimers and limitation of liability

The Service and products are provided "as is" to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential damages, including lost profits or business interruption.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising from your breach of these Terms, your personalization content, or your provision of recipient information without proper authority.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and attempt to resolve the matter informally for at least 30 days.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
